Introduction

Welcome to ProCreative360! These Terms of Service ("Terms") govern your access to and use of the ProCreative360 platform, including its mobile and desktop applications ("App"). By using the App, you agree to comply with these Terms. If you do not agree, you must not use the App.

Eligibility

To use the App, you must:

• Be at least 13 years old.

• Have the legal capacity to enter into a binding agreement.
  By using the App, you represent and warrant that you meet these requirements.

Account Responsibilities

When using the App, you agree not to:

Users are responsible for:

• Providing accurate and up-to-date information during account creation.

• Maintaining the confidentiality of their account credentials.

• Immediately notifying us of unauthorized access or breaches.
  ProCreative360 is not liable for any loss or damage resulting from unauthorized use of your account.

Acceptable Use Policy

When using the App, you agree not to:

• Engage in illegal, fraudulent, or harmful activities.

• Disrupt or interfere with the functionality of the App.

• Violate the rights of others, including intellectual property rights.
  Violation of this policy may result in account suspension or termination.

Intellectual Property Rights

ProCreative360 owns all rights, title, and interest in the App and its content. Users are granted a limited, non-exclusive license to use the App for personal or commercial purposes. Users may not:

• Copy, modify, or distribute any content without prior written consent.

• Use the App's trademarks or branding without authorization.

Payments and Refunds

If applicable, all fees for using the App are outlined during the purchase or subscription process. Payments are non-refundable except as required by law. Users are responsible for canceling subscriptions before the next billing cycle to avoid charges.

Termination of Service

ProCreative360 reserves the right to suspend or terminate accounts for:

• Breaching these Terms.

• Engaging in activities that harm the App or its users.
  Upon termination, your access to the App will cease immediately.
  

Liability Disclaimer

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. ProCreative360 is not liable for:

• Errors, interruptions, or unavailability of the App.

• Loss or damage resulting from your use of the App.
  

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Virginia, without regard to its conflict of law principles.

In the event of a dispute arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute informally by contacting ProCreative360 at hello@creative360.tech. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration conducted in Virginia under the rules of the American Arbitration Association.

If arbitration is not required or enforceable, any legal action will be brought exclusively in the courts located in Virginia. Users from outside the United States agree that their use of the App is subject to the laws of the United States and the State of Virginia.

Changes to the Terms

We may update these Terms from time to time. Users will be notified of material changes through the App or via email. Continued use of the App after updates constitutes acceptance of the revised Terms.
